PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT
These Terms & Conditions (“Agreement”) govern all bookings, road trips, expeditions, tours, self-drive journeys, vacation packages, and related travel services (“Trip”) arranged by Roy Cruiser LLP (“Roy Cruiser,” “we,” “us,” or “our”).
Roy Cruiser LLP is a Limited Liability Partnership organized under the laws of India.
By submitting a booking form, paying any amount, clicking acceptance electronically, or participating in a Trip, you (“Participant,” “you,” or “your”) agree to be legally bound by this Agreement. If you book on behalf of others (including minors), you confirm you have authority to bind them to these Terms.
If any separate itinerary is shared with you, it is indicative only unless expressly confirmed in writing. In case of any conflict, this Agreement prevails.
1. ROLE OF ROY CRUISER LLP
Roy Cruiser acts as a travel organizer and coordinator only. We arrange services through independent third-party providers (“Suppliers”) including hotels, transport operators, vehicle rental agencies, activity providers, and guides.
All Suppliers operate independently and are solely responsible for their services. Roy Cruiser does not control or supervise their operations and shall not be liable for:
Any claim relating to Supplier services must be made directly against the relevant Supplier.
Roy Cruiser’s liability is strictly limited as described in this Agreement.
2. BOOKING, PAYMENTS & PRICING

Failure to pay on time will be treated as cancellation by you.

All refunds, where applicable, will be processed after deducting:

Leaving a Trip early for any reason does not entitle you to any refund or credit.
3. PRICE INCREASES
Trip prices may increase due to:
Roy Cruiser reserves the right to revise prices before full payment. If an increase exceeds 10%, reasonable alternatives may be offered at our discretion.
4. CANCELLATION OR CHANGES BY ROY CRUISER
Roy Cruiser may cancel, modify, combine, reschedule, or alter a Trip for reasons including but not limited to:
In such cases, Roy Cruiser’s liability shall be limited strictly to forwarding any recoverable Supplier refunds. No compensation, damages, or additional liability shall arise.
Itineraries may change without prior notice due to weather, political conditions, road closures, mechanical breakdowns, health concerns, or similar events.
5. FORCE MAJEURE
Roy Cruiser shall not be liable for any delay, disruption, cancellation, or loss caused by events beyond reasonable control, including:
If a Trip is affected by Force Majeure, Roy Cruiser may reschedule, alter, postpone, or cancel the Trip. Refunds will be limited to amounts actually recovered from Suppliers.
You agree not to initiate chargebacks or payment disputes for Force Majeure-related cancellations.
6. PARTICIPANT RESPONSIBILITIES

7. VEHICLE USE & DAMAGE LIABILITY
If using your own vehicle, you assume full responsibility for:

8. REMOVAL FROM TRIP
Roy Cruiser reserves absolute discretion to remove any Participant who:
Removal will be at your own expense and without refund.
9. MEDICAL FITNESS & LIABILITY
By booking, you confirm you are physically and mentally fit for the Trip.
You are responsible for all medical expenses, evacuation costs, hospitalization, and emergency transport.
Roy Cruiser is not a medical provider and assumes no liability for treatment by third parties.
10. INSURANCE – MANDATORY
Participation requires:
Proof must be submitted before departure.
Failure to provide proof may result in denial of participation without refund.
Roy Cruiser is not an insurer and does not guarantee coverage adequacy.
11. BAGGAGE & PROHIBITED ITEMS
You must comply with Supplier baggage rules.
Strictly prohibited:
Violation may result in removal and reporting to authorities.
12. MINORS
Minimum age: 12 years.
Minors must be supervised at all times by a parent or legal guardian.
The booking adult indemnifies Roy Cruiser for any claims arising from a Minor’s participation.
13. MEDIA CONSENT
Roy Cruiser may use photographs and videos taken during the Trip for marketing purposes without compensation.
You may request removal of specific images in writing.
14. CLAIMS & DISPUTES
Complaints must be raised during the Trip to allow resolution.
Formal written complaints must be submitted within 30 days after Trip completion.
Failure to notify within this timeframe waives contractual remedies.
You agree not to initiate chargebacks before providing Roy Cruiser a fair opportunity to resolve the issue.
15. LIMITATION OF LIABILITY
To the maximum extent permitted under Indian law:

16. INDEMNITY
You agree to indemnify and hold harmless Roy Cruiser LLP, its partners, employees, affiliates, and representatives against any claims, losses, damages, liabilities, penalties, or legal costs arising from:
17. GOVERNING LAW & DISPUTE RESOLUTION (INDIA)
This Agreement shall be governed by and construed in accordance with the laws of India.
Any dispute shall first be attempted to be resolved amicably.
If unresolved, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.
You waive any right to class or collective proceedings.
Courts in New Delhi, India shall have exclusive jurisdiction for interim or enforcement matters.
18. SEVERABILITY
If any provision is held invalid under Indian law, the remaining provisions shall remain enforceable.
19. ENTIRE AGREEMENT
This Agreement constitutes the complete and final understanding between the parties and supersedes all prior discussions or representations.
